Oops... looks like willfully communicated/transmitted classified information from an unsecure source. I'd say jail time and maybe he gave hillary a pass hoping he wouldn't be indicted when he got caught. The gamesmanship at the upper echelons needs to be handled in a very harsh manner.
Considering the terms of service for gmail include the ownership of the content transmitted, received or drafted belongs to google, i'd say he violated the law and needs to be held accountable with prejudice.

I agree completely with what You have said and as You pointed out a MOTIVE not to prosecute Hillary Clinton and perhaps draw attention to his own violations of Federal Law on private Email use with sensitive or classified information.
