Army officer’s assault suit against police can proceed to trial

It seems to Me the place to start would be by telling Him the reason for the stop. In 40 years of Law Enforcement that is always what i started with. I did that before I even asked for a license or registration to be shown. Sometimes I would not even activate the lights if I thought the location closest to the violation may have been hazardous or if they pulled over in an unsafe spot get them to move to a safer location. Also i didn't want anyone getting out of the car for both their safety from passing traffic or my own by losing that control. Unless there was an offense to which and arrest had to be made there was no reason to get out of the car. Although I have made a lot of arrest be they criminal of in some cases motor vehicle offenses (of which in our state there are only 5 for motor vehicle offenses) I've NEVER had a complaint of excessive force against Me. Often I would give a break to members of the US Armed Forces anyway if it wasn't anything too serious and not write anything and leave it as a verbal warning only. Give Me lip service though You can expect a citation as one Air Force Major I stopped found out when if He didn't show the poor attitude He did would not have even got a citation issued. That's a matter of talking Yourself into court when You could have had a break.
