"The Preamble to the United States Constitution, beginning with the words We the People, is a brief introductory statement of the US Constitution's fundamental purposes and guiding principles." When it was initially written, We the People, Had a very narrow meaning. Amendments to the Bill of Rights over the years have widened that meaning considerably. But at it's root it still means, law abiding Citizens of the United States of America. Carbajal-Flores is a criminal under the immigration laws of our country. He has been since he entered the country illegally, and took up residence. It matters not how well He's acted since that time. Until He makes a formal request to become a citizen, passes the test, and swears the Oath, He is a criminal, actively in the commission of a crime, a prohibited person.
"U.S. District Judge Sharon Johnson Coleman wrote in her ruling that the Second Amendment "presumptively*(sic)* protects firearms possession by undocumented persons" because nothing in the wording of the Constitution specifically says they can't own guns." There is a fault in Her logic that renders Her opinion moot.
