A U.S. military doctor — who previously made headlines as the first known active duty Army officer to come out as transgender — and their spouse were federally indicted in Maryland on Wednesday for attempting to pass sensitive medical information about members of the military to a person who they believed worked for the Russian government.

Seems like in order to avoid prosecution all you have to do is say you're a strange gender.

While I agree the gender comment is a red herring, if this case gets more media attention I am sure some defense lawyer will try to match this horrible decision to talk to Russians with the transition. Knowing what I know about transition and all the elements involved, the defense will at a minimum cause a hiccup for the prosecution. Glad I never worked with or received care from either as their decision making capabilities are grossly flawed.
