MY SAY: You miss two major points. 1) Since 2009 the Military Commissions Act has governed the legal process affecting unlawful combatant Islamists who want to kill us held at the US military detention facility at Guantanamo Bay, Cuba. This gives detainees accused of war crimes virtually the same rights you or I would enjoy in federal court of law. 2) Unlawful combatants are not covered in the Geneva Conventions or Law of War. They are treated within the spirit of Geneva through the benevolence of the US. What this means is, the US already bastardized any hope of a speedy resolution with the 2009 MCA (Obama), and ignored previous precedent from 1942, when 6 of 8 German saboteurs, caught dry foot on US soil, were executed within 8 weeks of their capture after being denied habeas corpus and tried by military commission, which found them guilty of violating Geneva and Law of War. They had the means and intent to kill and destroy property, but they actually did neither. No worries, death penalty invoked because they were found guilty of spying.
