Before the advent of air travel, landowners owned an infinitely tall column of air rising above their plot. (The Latin doctrine was Cujus est solum ejus usque ad coelum, or “whose is the soil, his it is up to the sky.”) In 1946 the Supreme Court acknowledged that the air had become a “public highway,” but a landowner still had dominion over “at least as much of the space above the ground as he can occupy or use in connection with the land.”

Flying as low as 80 feet was deemed by SCOTUS as an invasion of private property. Today, the federal government considers the area above 500 feet to be navigable airspace in uncongested areas. The Supreme Court hasn’t explicitly accepted that as the upper limit of property ownership, however it’s a useful guideline in trespass cases. So unless you own some very tall buildings, your private airspace probably ends somewhere between 80 and 500 feet above the ground.

There's no need to send the drones; they are already tracking you via your Samsung cell phones and other gadgets.

I no the police have never had a problem coming to my home. I have told them they don't even need a warrant if they want to come and look around in my home. I don't have a basement and built an underground safe house like the one fema had on their website because we had tornadoes go threw here and I had no where to go I would have driven right into them if I would have tried to go to town where people normally go and I am far enough out I can't hear the sirens. So one day an officer stopped by and inquired about the underground which I am also making a root cellar from. I invited him right in to look around he thought it was pretty neat. I am a law abiding person without even a driving ticket. Nothing to hide from anyone. We had some teenagers who built a thing from a remote helicopter and it had a camera on it and the neighbor a couple miles away shot it from his sky the kids claimed damage to property and lost because it was not supposed to be there. But we are required if we want to put up a wind generator that is higher then 100ft to get contact and get permits for that because over 100ft is not our space where we are. The kids in that case were using it to spy and were caught breaking in and stealing from people. So yes I think people would have a good case. They could have one of those cameras on a persons land outside and we never no it. But to fly a drone no I don't agree and fight that bill by petitions.

Why damage them - plan ahead (discreetly of course) and attempt to jam the controlling frequencies. Once it falls on your property you can do a little bit of technical or rudimentary investigation and find out who the controlling entity is. This will give you the heads up on whomever is spying on you - knowing is half the battle in this type of unauthorized surveillance.
If a law enforcement entity is justified and is going by the laws they are suppose to be upholding - then they would have a search warrant and hand it to you in person. We have an awesome constitution that should be guiding our federal, state and local authorities in keeping them on the straight and narrow - when they slip off that and enter the dark side, then it time for legal action to be pursued.

That would be a nice thought - but in this day and age it might make the intruder more determined and go into 'dark' mode so it would be much more difficult to discover the source before something 'bad' happens. Of course, if you were to tactically shoot the rotor(s) - you should be able to recover the UAV and then make contact with someone you trust that knows their way around electronics and computers and still find out the source. But, I do get where you are coming from.

Just a high gain WIFI antenna or antennas transmitting 2.4 to 5.8 will most likely jam the signal. In most cases it will cause the craft to revert to its return home logic where you would be able to find the operator. Most of these aircraft have very limited flight time which preclude long distance flights and extended loiter times. If someone wants to loiter for a while they would have to be very close to you. Otherwise all they can do is maybe one pass and return home.

I am not suggesting to jam since there are FCC rules on how much power you can output.
In most cases wait a few minutes and follow it home.

I'm sure I'll find out once I do it. It more than likely depends on what type of state you are in. If in Texas I could see it being target practice time. Here in Maryland, I'd probably be imprisoned for half of my life.

SPC Christopher Smith - You're so right brother. Even here in VA things are now like MD we use to be closer to what Texas is. Very sad. Stay strong.

PV2 Violet Case outside the city limits I guess you might have a chance of getting away with whatever you wanted to do, but I'm sure you'd still have a few people stopping by to ask questions, I just hope it's duck season so you have a valid response, lol.

Cpl Brett Wagner I never thought my home state of VA would have gotten soft on privacy and private property, I hope they haven't gotten rid of the home entry protections. Shaking my head in shame.

Target
heck if you call dnr cause there are wild animals trying to come at you they tell us to shoot them and bury them . Opps to me thats a flying wild animal they no up here I don't take much crap, I had a guy cutting down some of my trees and the 5th time he did it I called the cops each time and they did nothing. So I told them I would just take care of things myself the next time he comes on my property and tresspasses. They just told him to stay off cause I was getting pretty serious. But I never could see the neighbors house well now that he cut part of it out I can now and the urks my chains. This town knows when I say enough is enough I go up the chain of command and the Congressman likes me here. lol... This target was out at 100 ft I don't know maybe I think I might be able to hit them what do you guys think. Got my new 308 and had not done any shooting for 13 yrs and went to site it in the first few were to the left a bit but my buddy has all the stuff to sight them in with that lazer and he said it was off from the store. So he sighted it with the lazer thing I went out to see how he did and was hitting pretty good on it I thought. So I think the little sky demons will be buried for sure. But who knows maybe these things will shoot back these days one would never no. lol

CPL Brett Wagner, some states are different. But when I heard some states now have it if a burglar comes in your home and breaks his leg on your property he can sue you. ISn't that a crock? And one time the policeman here told me if someone breaks into you home here in my area that they have a force against force law. IF someone breaks in a uses a gun so can you , but if they use a hammer you have to use what they do. That too I told all of them was a crock I will protect myself in any means possible and deal with the rest later. Being disabled I can not run anymore. We trained and protected our country and then they try to say we can't protect our homes how dumb is that?
