Did you miss the point that the US government had NO evidence OF ANYTHING against this person AND HAD NEVER had any evidence OF ANYTHING against this person?

On the other hand, since he wasn't an American then he obviously never had any unalienable rights that were granted by God (not "Man") so that means that it is perfectly OK to incarcerate him for as long as anyone feels like doing so - and by extension simply shoot him if someone feels like doing it.

Right?

Good afternoon COL.,
12 prisoners released from GTMO last year returned to Jihad.

18% of the total imprisoned did return to Juhad and 11% may have. Perhaps, the contacts he has made while in custody will help him find new land mines to store? I'm so glad he has had his medical and dental updated before he is deployed.

What does Christian have to do with anything on his incarceration, or release? Is that a jab at a secular country you think is run by Christians? The last time I checked, BLT Christianity is not Christian. They only worship a god that helps people of color. Plus, it is Marxist based. You know, give me free cell phones.

If this fellow is innocent, it is a tragedy for him to have been kept behind bars. I'm not in a position to know. Are you Sir?

You might want to compare that with the 60% recidivism rate for the rest of America's penal system.

Now, I'm going to ask you a VERY simple question and I expect you to answer it honestly.

IF you were arrested and tossed into jail for 14 years without any trial, chance to present a defence, charge being laid, actual evidence being found against you, AND - by all reports - never having had anything whatsoever to do with the people you were "accused" of supporting, WOULD YOU feel kindly disposed towards the people who did that to you ESPECIALLY if you have absolutely no legal recourse that would allow you to call them to account for their behaviour AND return home only to trumpet the virtues of their systems of law and government?

What does "Christian" have to do with anything? Well only that he "doesn't worship the right God" and therefore, IN ADDITION TO not being an American, he isn't entitled to any of the unalienable rights that "the right God" granted to Americans only.

FYI, the population of the United States of America is approximately 70.6% "Christian" and the membership of "Congress" is approximately 91.8% "Christian". If you want to tell me that [a] you are actually serious, and [b] the United States of America is NOT "run by 'Christians' I'm going to have to start measuring you up for one of those sports coats with the loooooooooooooooooong sleeves that buckle in the back.

By the way, according to all accounts "Christianity" is based on the teachings (which are NOT verifiably his) of a Radical Revolutionary Socialist Jewish Rabbi who was born in approximately 6BC (and probably in or about the month of June) and died on 07 APR 30AD while "Marxism" is based on the writings (which are verifiably his) of Karl Marx who was born on )% MAY 1818. Now I know that there is some problem teaching basic concepts of time and arithmetic in one or two American schools BUT where and when I went to school we learned that it is REALLY difficult for someone who died approximately 1,788 before someone else was born to base ANYTHING on the writings of the person who wasn't even born until approximately 1,788 years after they died. Your school, of course, may have taught you something else as is their right because of their First Amendment rights to "Freedom of Religion" and "Freedom of Speech".

As far as the "if the fellow is innocent" qualifier, would you please tell me when the onus changed from "The State is required to prove guilt beyond a reasonable doubt and that includes proving ALL of the elements of the offence." to "The Convict is required to prove absolutely that they did not commit the crime for which they were imprisoned and must do so without the assistance of any legal counsel and also without the chance to present that proof."?

FYI, one of the things which triggered the English Civil War and the adoption of "The Bill of Rights (1687)" was the existence of the "Star Chamber" where "trials" were held without the accused being present (or even knowing about them) and - after the obviously preordained "Guilty" verdict was handed down - people were imprisoned and/or executed until such time as they could prove that they weren't guilty of whatever it was they had been convicted of (although they weren't necessarily told what that was). You might find a STRONG reflection of that in the first 10 Amendments to the Constitution of the United States of America (but you won't find even a SERIOUS hint of it at Guantanamo).

If I was innocent and held for 14yrs. I would agree with you. Is he innocent? Are the land mines related to him? I don't know.

How does enemies caught on the battlefield and sent to GITMO have anything to do with Americans in jail? Other than, you see it as some kind of Star Chamber? It appears the American tax payer has paid for their defence council, medical and dental bill. Some sweethearts have gone back to murdering in the name of Muhammad after POTUS let them go. American families are real happy about that.
If Congress and the Senate were behaving themselves as Christians, America would not be 19 trillion in debt. Nor, would the black family be destroyed with the welfare state. Christ would want people to work. I could go on. But, I suspect you can see my point.

Cpl Mark A. Morris - You are right on. Gitmo is not a part of the American penal system. Detainees there are not criminals. The only relevant question is, Are they enemy combatants? Sadly, if they aren't when incarcerated there, I suspect they are when they leave.

I noted this in the article about this nice guy who was released. "Obaidullah was initially arrested by U.S. special forces in 2002 because unarmed land mines were found buried near his house. However, the U.S. government did not formally launch charges against him until 2008."
My thought is he is NOT innocent but part of the supply chain. He was storing mines... Note: Always good and smart to store mines unarmed if your house is nearby. :)
I wonder how many days before reports will come in on his contacting his friends. He is now well rested, well studied, and ready to continue the fight. Currently, US Forces do not have an R&R center for multiple years of no work, no need to worry about earning a living.
I wonder if they will ever give us a thank you for the cost free resort living.
They had very limited travel when living in AFG, some were living in caves in a cold environment and on poor rations. At release time, check the change is weight and physical ability. Good docs, and good weather, some have even got higher cholesterol because the evil Americans gave them all the food they wanted. I am sure in 10 years we will get sued by Taliban for their medical problems from high cholesterol.

SSgt GG-15 RET Jim Lint - Private; If I came from a culture where "blood feud" was a cultural norm and someone "unjustly" deprived me of 14 years of freedom I'd probably go looking for the people who could help me get my revenge.

Oh wait; I'm partly of Scottish and Irish (and Swedish too) extraction so there isn't any "IF" involved here, is there?

Of course, if this person does that then that will PROVE that they were a terrorist all along - won't it?

I hear 30% goes back, this report says 144 went back to the enemy. In the Army, I think this is a small Company! So, we have released, or given our enemy a company on the battlefield. I do not want to allow them to prove they are loyal to the enemy and maybe lose more friends and Americans. We have a strange war. We did not do this with WWII.

The Office of the Director of National Intelligence (ODNI) on Monday released its latest biannual report on Guantanamo recidivists — detainees who the intelligence community says are confirmed or suspected of re-engaging in terrorist activity after being released from the detention facility.

The new report says that as of January 15, 2016 the number of Guantanamo detainees released by the Obama administration suspected of re-engaging has doubled from six to 12 since the last recidivism report was released six months ago. A footnote to the report says, however, that the Defense Intelligence Agency "assesses five additional detainees are suspected of re-engagement." The report goes on to say the number of detainees who have been confirmed of re-engaging has increased by one and now stands at seven of 144 detainees released during Obama's tenure; and the number of detainees suspected of and confirmed of re-engagement who were killed has increased by three. The report also says one former detainee transferred under the Bush administration was newly suspected of re-engagement.
