There are a number of things required for a contract to exist. Do the texts provide all those things? That is what the court will have to decide. Contracts don't actually have to be written. The text message are written and can easily serve as a contract if all the requirements are met. Primary to its existence is if the texts can show agreement since the basics like capable parties, legal purpose and consideration will be there before mutual consent can exist. It's been a long time since I have tried to use what I learned in contract law. Any lawyers out there should feel free to chime in if I'm barking up the wrong tree
