I am stuck in this situation, I filed for Sleep Apnea (diagnosed severe) secondary to weight gain because of my bilateral Knee Issues which have gotten much worse in the last 8 to 10 years and now a Total Knee Replacement. The reason they denied me was due to age. I feel I fall under the weight gain was "At least as Likely" as the age reason and according to VA directives and a Congressional Act they are supposed to find in favor of the Veteran.
In 2002, Congress passed legislation requiring the Veterans Appeals Court to ensure the “benefit of the doubt” rule was followed properly in the disability claims process.
