MSgt Ken Flood I disagree. I think he was exercising his right to peacefully protest as protected by the first amendment.
I also think it is a totally insincere gesture, as he is not doing anything productive to work towards ending the injustice. He makes millions of dollars for playing a game. There are numerous celebrities, pro athletes, actors, musicians, and just wealthy people who have actually taken action. They talk about a problem, and then work towards a solution. He is just a spoiled brat throwing a fit to get attention.

His 1st amendment rights are protections from the government for private citizens. When he wears a uniform, he represents the 49'ers and the NFL. As an employee in uniform, he should be held to a standard of conduct consistent with the organization. He is protected from the U.S. government for sitting down in protest. He isn't protected from the NFL, 49ers, or any sponsors who might be offended by his actions.
Having had the opportunity to visit many different countries throughout my life, I'm always surprised by the over-the-top criticism people have of our country. Sure, we aren't perfect, but from my observation we are a lot better than nearly all others.
