We brought over a lot of traditions from the British Navy and this was one we could have and should have forgone IMO

Did you know that flogging was considered to be legal reform when the British Navy initiated it. During those pre-Elizabethan era times, they gave the death penalty for minor crimes, but if you are at sea and need that body to run the ship, you can't hang him. You can give him 10 lashes and he would normally be able to continue his duties after a couple of days.
Remember that a lot of countries during the period didn't think a confession was valid unless they had tortured you for awhile.
