Khalid Sheikh Mohammed and the problem of torture - - Via Washington Times by Judge Napolitano
MY SAY: The Good Judge oversimplifies the conundrum that is the trial for unlawful combatant Islamists who want to kill us and who are charged with war crimes and being held at the US military detention facility at Guantanamo Bay, Cuba. Obama's 2009 Military Commissions Act made worse the 2006 MCA enacted by George W. Bush and then SEC DEF Don Rumsfeld. These unnecessary laws sought to soften the blow for terrorists and gave them virtually the same rights you or I would enjoy in a civilian federal court of law. In my opinion, these laws amount to treason, as they certainly give aid and comfort to the enemy. In 1942, 6 of 8 German saboteurs, caught dry foot on US soil, were executed less than 8 weeks after capture after being denied habeas corpus and tried by military commission, Oh, and none of them had hurt a fly or destroyed any property, they merely had the means in intent to do so. They were convicted of breaking the Geneva Conventions and Law of War and then sentenced to death. What's different now?
