When I was on active duty, I was left with the impression that illegal orders (irrespective of their source), were not to be followed. As an Army officer if I were to knowingly follow an illegal order it would be my butt. I ask this question only because it seems that any instruction that originates in a bureaucratic department even when in direct contravention to Federal Statute, is followed without question by any and all Federal Law Enforcement Agencies.
If the chief executive ordered that all these people entering the US illegally were to be summarily executed, would these same people also follow those orders without question. This is really very disturbing.

I would guess that the Border Patrol guys are not blinding following "...any instruction that originates in a bureaucratic depatrment...." I would think that the BP officer is following policy.
I would also venture a guess that he doesn't like that he has to let them in, but he's merely doing his job.

Instructions from a bureaucratic agency does not make the laws passed in Congress by our duly elected representatives null and void. Having been ordered to violate the law is not a defense in either military or civilian courts.
