Not sure what the big deal is, any employee can sue for being fired from a state government job which is all the Guard or Reserves are. Doesn't mean it's going to work out as the want though.

He was on State Patrol IIRC and deployed and got lung damage from burn pits. State patrol refused to accommodate his ADA request

SFC Terry Stinnett From what I've seen so is the VA so the state followed what the feds were doing.
