Court Fight in Michigan Over Dead People on Voter Lists Heats Up

SFC Casey O'Mally - It seems that the state is arguing that they have no responsibility to DO anything to maintain the voter roles as long as they SAY they have some sort of program, plan, or policy -- regardless of whether that program, plan, or policy actually accomplishes anything.

No reasonable person expects any state to purge 100% of ineligible voters instantly or even quickly, but on the other hand, the Michigan position is that they don't have to show that they have done anything because the federal law fails to set any specific measurable standard.

If there is no specific requirement to meet, then one cannot argue that they have failed to comply. Unless, of course, one can prove that they have purged NO ONE. Otherwise it is a question of degree, and with no specific requirement, one cannot say they have failed to comply.

Really the argument is that they haven't complied with what THAT PERSON thinks is a sufficient level of removal. Which is an opinion. Generally speaking, opinions are not enforceable by the courts. Especially not opinions of folks outside of government trying to force government to comply.

MSG Thomas Currie p perhaps instead of going with the limited information of a "news media" report, Michigan residents/voters can review the information provided by the DOS office on their methods. They routinely get death notice information from SSA and state health department and purges those voters. Similarly, they coordinate at county & city level with those election offices. More than once in my life I've met folks with the exact same name, not otherwise related to each other, who could potentially show up on the voter registration lists.
