Gallego is over the top, and off base.

I actually agree with stripping Flynn of his benefits - after recall to active duty and trial by Court Martial. But Gallego's reasoning is off (asking the DoD to help secure the elections is stupid and wrong, but not treason, and stripping honorably discharged veterans of their VA benefits without due process is unConstitutional). Flynn can (and should) be tried for his remarks about Biden, for his violations of security, and possibly more. But not for treason. And he should not have any benefits removed until he is convicted by a court martial - *if* he is convicted.

While we are at it, let's toss in Austin, Milley and the rest of the JCS who, at best, stood idly by as Americans were left to the savagery of the Taliban following "Let's go Brandon's" disgraceful bugout.

Capt Gregory Prickett - Except that there was no insurrection. There was no attempt to overthrow the government. There was an attempt to prevent one specific person, representing the head of one BRANCH of a three-branched government, from taking power. There was no attempt to replace Congress; no attempt to replace the courts; no military imposition of martial law - or an attempt for such.

insurrection: a violent uprising against an authority or government (As defined by Google).

This was a mostly peaceful, yet rowdy, uprising against the person who was not yet, but would become an authority within government.

(And yes, there was violence. But if BLM gets to claim "mostly peaceful," then so can I. Because there was very little actual violence. Lots of rowdiness, little violence.)

Of course I get to tell you. I made a very good living telling operators what they should do. If they took my advice I got paid. If they didn't, I got paid. Beautiful symmetry there. Levity aside, the old saw about viewing the world through different lenses applies here. I have no doubt that there are multiple federal judges who share your assessment. Therein lies the schism. Judge shopping is not limited blue lenses or red lenses. Unfortunately. Also unfortunate, and dangerous, is that the schism continues to grow. Something in the neighborhood of half (because no one really knows) of the electorate disagrees with the premise the committee has based itself on.

Capt Gregory Prickett I said "mostly peaceful."

And I specifically said it was because BLM was mostly peaceful. And if they get to call theirs mostly peaceful, so do I.

SFC Casey O'Mally - They did attempt an insurrection. They attacked the Capitol with the purpose of stopping the certification of Electoral College votes - which is a constitutional process. What else do you call that?

Add in the fact they also went in with the intent of murdering Congressmembers AND the Vice President on top of it.

Definition of insurrection: "a violent uprising against an authority or government."

Legal definition: "18 U.S. Code § 2383 - Rebellion or insurrection"

"Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States."

It was not "mostly peaceful." At all. You call that "rowdy?" Seriously? You people are freaking deranged I swear.

BLM protests WERE mostly peaceful. They also weren't attempting to stop constitutional processes, stop elections. The ones that turned violent were caused by outside agitators OR the police attacking the protesters. The police would even attack the press who were covering protests. So spare me with this BLM comparison. If BLM did anything similar, no one would have walked away that day like all those MAGAts did.
