I don't like it. But...
If you read the whole article, it discusses that they are not allowed to screen social media in hiring decisions. It also says that because the posts were made prior to his hire, he had not violated any rules.
They had no choice here - rules is rules, and the rules say what he did previously doesn't matter. If he were to make the same post today, it would be a totally different matter.
