White House approves military to use lethal force at southern border

MAJ Ken Landgren: This is in violation of the Posse Comitatus Act, 18 U.S.C. 1385. The act specifically applies to the Army and Air Force, although both the Navy and Marine Corps have regulations which follow the Posse Comitatus Act. The military is not to be used for enforcement of federal domestic policies. The reserve components can be called up by governors in a law enforcement capacity but only within their own state or an adjacent state (must actually abut the other state).
This article is from late last year and there was a heated debate regarding the Posse Comitatus Act and the role of the military on the border. While John Kelly signed an order authorizing its use, the order basically went into File 13 and has not been enforced. Currently the military does stuff like stringing wire.
