Great followup on my recent post! But as far as I am concerned, this ship rests in territorial waters of the US and not in international waters! It was also used by an enemy of the US as a weapon during our war of independence of the British government. It was deliberately sunk by the British to help sideline the American forces. In my humble opinion LTC (Join to see), she will be and is ours. If our country wants to gift any remains to Australia or England, that will have to be with the blessing of our legislature and the people of the US that won our independence from England!

Ironically, the city that built the ship, the Museum of that City said that that ship belongs to the us as part of The Spoils of War

LTC (Join to see) Excellent Article, Rules of the Sea, Is it a Military Ship then it Remains Property of the Country Who's Flag It Fought Under. If it is a Civilian Vessel, Finders Keepers but I'm Sure there will be a Mighty Row over this Famous Ship. Somewhere I have a Picture of Me Under the Statue of Capt Cook in Victoria, BC.

PO1 William "Chip" Nagel She was not a flagged manned war vessel at the time the British used her hull to block American forces from entering port! She was a relic even then and the British chose to use her as a prison ship to house our colonial troops...not a man-of-war. They deliberately sunk her and it was not by battle action. And since she was unmanned, she is not a war grave.
