There is no such thing as the "war on terror." There is however a Global War on Terror. There is also an Authorization for the Use of Military Force still in effect. There is also a confirmation that foreign nationals, even those on actual (as opposed to "de facto") US soil, do not have the right to habeas corpus. The timing of this action is curious, considering that Justice Kennedy, the Supreme Court Justice who recently announced that he is retiring at the end of the month, is also the Justice who's vote in Boumediene vs. Bush was the deciding vote, and that Justice Kennedy wrote the decision for the majority in the case which, among other things, determined that unlawful-combatant-Islamists-who-want-to-kill-us were entitled to petition for habeas corpus (due process under the law) because the US military detention facility at Guantanamo Bay, Cuba, was on "de facto" US soil. The Alt-Left can't stand the fact that Gitmo exists in the first place, let alone the fact that our enemies are lafully held without charge or trial "until the end of hostilities," as per the Geneva Conventions. They are not held under the authority of the Conventions, mainly because the Conventions do not recognize unlawful combatants. The detainees held there and previously, are all lucky to be alive. Even lawful combatant POW's may be held without charge or trial until the end of hostilities, just like over 400,000 mostly German captives were held in the US thusly during WWII. US District Judge Thomas Hogan must by law hear the petition, but is under no obligation, by law or precedent, to grant the petition. Thirty percent of released Gitmo detainees are know or suspected to have returned to the fight, one even helped lead the attack on US diplomatic missions in Benghazi in 2012, which cost the lives of four brave Americans, including a US Ambassador. Until all Islamists are dead or no longer have the means or will to kill us we must defend ourselves, and Gitmo is a small piece to the big puzzle of how we win the Global War on Terror.
