There is not anyone on RP that can answer this. Recommend you seek professional legal counsel.

A currently serving SM who had a prior rape in 1969? That would make this SM about 60 years old right now and not currently serving.

PFC Donnie Harold Harris - you dropped the charges therefore you have no grounds to sue the Army over this. If he's still alive, you could file a civil suit against him.

PFC Donnie Harold Harris - Why do you feel it's the Army's fault that you dropped the charges? Had the civilian charges remained, the Army may have the choice of court martial verses a civilian trial, but something would have happened, they were already court martialing the guy for another rape. What it appears to be as a case that the local authorities didn't want to pursue it.

They moved the rapist to another location as the Catholic Church did. For their protection allowing him to re affined.

Both of you shaming the victim need some Jesus. There is nothing in his post about "the Army's fault" nor "sue the Army".

Statute of limitations has long since ran out so there is nothing you can do as far as criminal charges. However, anyone can sue anyone else for literally any, or no, reason in civil court. That said, 51 years is a long time. evidence could be lost, witnesses could have died, etc. It's always a hard sell trying to sue the govt for anything. Personally, I would advise against it after such a long period of time simply because your chances of success are very low and, unless you're rich, you're going to spend a lot of money with little or no return.
