So I just saw on Fox News this "Red Flag" states where authorities can seize firearms if they believe a person is a threat to themselves or the public. Does anyone know of anyone that this has happened to, I live in one the Red Flag states. I can't wait to move to Texas or Cali(also a red flag state probably not moving there now).

MSgt Steve Sweeney - I was not advocating that just showing off my property. This is a better view.

Not here in NC. This would save many more lives if it was based on taking automobiles away from drunk drivers!

How about we just universally take things away from people who cant handle them? Guns, cars, phones (although if you take away the car the phone is pretty harmless) etc...

I think most "Red Flag" laws are fairly new (at least the modern version of Red Flag type laws) historically speaking. Time will tell the tale as to just how liberally they get applied, but as for me, the only guy I know who got his gun taken away was an old friend who went to prison for murder, so...yeah.

Id also look into who has had them seized and returned vs. seized and not returned. That would be the biggest concern in my opinion.

I've known someone what had property seized and was told it would be returned, but has yet to. We both come to the conclusion, that statement is a lie...once it's seized, IT'S GONE!

SFC Christopher Taggart - Of course every story that's told here is anecdotal, but there are plenty of cased where they get it back. I tend to agree with you though your chances of maintaining property go up the longer you go with out having it seized.

There have been several vets with mental health issues that were, are the VA told the authorities, asked to turn them in, or suffer.

It's one of those "I know a guy who knew a guy who had a cousin who had it happen kinda things"...

Sgt Adrian Jones The Washington Post has an article about the laws. According to the article California is one of the five states that allow this seizure. It also states that it has to be ordered by a judge. Though in the states listed, I doubt that a local judge would not sign off on it. It also states that it is a TEMPORARY seizure when someone poses a threat to themselves or others. What I want to know is first off, what burden of proof is required for such a seizure to occur, how long is temporary, what process is in place for a person who has this action taken to redress the issue? I know when purchasing a firearm, they ask "under penalty of perjury" if a person is addicted to drugs or alcohol. So the background check is already being enhanced to reduce the likelihood of an unstable person from acquiring a firearm through legal channels.

Five states allow guns to be seized before someone can commit violence
Measures to let police or family members ask a judge to block someone’s access to firearms have been proposed in 18 other states.
