If I volunteer to take a family care plan chapter, but still get sent down range, can my husband's command chapter him for the same reason?

My husband and I are dual Military. Our old unit did not require a family care plan as our pcs date was shortly after I got off maturity leave. I did not intend to reenlist since my ets date was only a few months after the baby was born, but my husband wants to make this a career. The retention NCO would not let him extend to my ets date which was fine we were okay with him leaving the baby and I alone til my ets leave which would have only been a few months from him leaving. well long story short retention made a big deal about me being alone with the baby and convinced my husband it was a good idea that i reenlist so I can go with him to the new duty station and just said that I could get out over a family care plan when I got there. Since we already knew we didnt have a working one at our current duty station. So we PCSED and now are at a road block the brigade we are in is deploying like people already down range. My First Sargent told me to expect to leave with the second push of people in march. But we still do not have a family care plan and the regulation says your non deployable til ones on file and approved by both commanders. I read the regulation but according to that my old unit should not have let me reenlist. But it also says you are non deploy-able til you have a plan in place. We are afraid if they send me he will have to be the one to take the chapter but he wants to stay in I dont. We are the same rank and both SPC (P). Only got mine because I went to the board pregnant. Can they chapter him out if I am the one to volunteer to take the chapter but still get sent down range? I do not want to stay in I had no intention of reenlisting but got talked into it by my husband and retention.We just dont want to hurt his career. I really dont want to stay in and probably wouldnt be in much longer anyway as I am really struggling with PT since I had the baby so I am having a really hard time passing my PT even though I have tried really hard with no luck I haven't gotten any better no matter how much I run and not we are in Colorado and trying to get used to the elevation it is making it even harder any help would be appropriated.

Your retention is a non issue. You can be non deployable and reenlist.
Your can still separate under your family care plan. Just talk with your command about initiating it. If you received a bonus you'll have to pay it back. It's still an honorable discharge and you'll retain all your benefits.

Neither of us got a bonus. My husband just got choice of duty station. I just followed him when I reenlisted so we didn't get separated.

SPC (Join to see) I'm just saying if you had one you'd pay it back. Whether you received one is irrelevant to whether or not you're eligible to separate under FCP.
I only point out the retention piece because half of your post is talking about retention. Retention has no bearing in this situation, and your family care plan has no bearing on retention.

You’ve still got to get a family care plan figured out. Even if you weren’t in what’s your plan if you get injured or hurt while he’s down range or TDY? Family care plans cover the interim first 24-48 hours as well as the longer term needs. Get it done Soldiers! Don’t make your child ashamed of your service at a later date! If you re-enlisted you made a commitment. Now if you can convert it to a reserve status before your ets fine but until then work out who’s gonna take care of your baby if either or both of you are deployed. Good luck and get it done!

SPC (Join to see) So you need to develop a Family Care Plan. however you found yourself with reenlistment obligations, doesn't matter. You are in it now. They could Chapter either of you depending how you respond to being Military parents. AR635-200 paragraph 5-8, then there is Chapter 6. Recommend you seek legal assistance so you understand the pros and cons of your upcoming decision.
Recommemd you and your husband engage with your command and your extended family and develop that family care plan. LTC John Mohor said, it's not just deployment. What happens if you are both in an accident? I do not know if you or your unit had fraudulently or erroneously reenlisted you. This problem is fixable. With a Family Care Plan.
Your comments about being left alone if your husband reenlisted...who told you that? Were you enrolled in MACP? If you ETSed, you'd be a dependent and authorized to move with him.
Yes PT at Carson sucks. Keep at it. It takes time and doing PT to adjust. After a while you won't notice it.

Both my unit and retention said since I didn't have enough time on my contract I could not follow him to Carson. So I would have to stay at polk until my ets. Even though we are enrolled in the macp. I had to have permission from my battalion commander to reenlist since I was pregnant and my pt was expired. And she had asked if we had a family care plan in the works. Because we were going to need one if we both reenlisted. The retention nco told her that we had one in the works so she approved my reenlistment. I was no present when my first Sargent and retention talked with the ltc. I was talked to off line after the meeting then had.
