What disciplinary actions if any are taken against a military member that violates Article 88 of the UCMJ, 10 U.S.C. 888 on social media?

Best rule of thumb in life in general, never talk about your supervisors. Never talk political or religion, even when someone says it's ok to talk to them about it. So many different reasons as to why, but just don't and you will never have to worry about Article 88.

PVT Karl Goode I’m sorry man, laugh with me on this one because that is definitely not how that was to come out. You said, “You agree with me on time and place and in workplace is unprofessional”, I responded to that by adding “and Kaepernick sucks”. Because of the Ralley Point format it added your name to the front of that making it appear and sound as if I was saying you and him suck. My bad brother, in no way shape or form did I mean for it to come out like that or were I saying you suck. Lol! Perhaps I should of proof read it before I sent it. Although in all fairness I probably still wouldn’t of caught it being I wasn’t even thinking like that. Sorry!

I've seen mostly LORs but if it is serious, someone could be given an Art 15 or courtmartialed.

Thank you. My next question is where do they draw the line between serious and non-serious ? Is pretty much anything except physical threats against the POTUS,Congress ect. considered non-serious ?

SrA (Join to see) - It depends on the Chain of Command in charge of the Servicemember, really. There is no hard and fast line or rules at this point.

No sensible commander would take action on this without a conversation with the base JAG. It depends on what the legal guys and the base or wing CC think.

Well, I suppose it can be pretty subjective. As Maj Zeski pointed out, there are no hard lines or rules at this point. More than likely members of the JAG Corps might differ in their opinions as well.

One person, an officer, used to post contemptuous speech about President Trump that removed all posts on RP and other social media. Looks like the DODIG does keep an eye on these infractions. When AD servicemembers are involved.
