I am an avid supporter of the 2nd Ammendment and the freedom to own High capacity magazines, assault rifles, and handguns. I have a CPL as well. One question that has been on my mind though is about service members who PCS to states that have stupid laws like magazine limits and bans on assault rifles. What is required of the SM? Do they have to give up their weapons that do not meet the new states guidelines or is there protection for SMs who own them and do not want to lose them to liberal POS regs?

Check with the local laws for the state you are moving to.  You will have to abide by the state laws though.  I moved to CA from TN, which is night and day different as far as their gun laws are concerned.  Unfortunately, you will have to decide what to do with the weapons.  You can have a family member hold them, put them in storage, or sell them.  If you are moving to a very restrictive state, I wouldn't chance bringing them to that state.  It isn't worth getting felony weapons charges...


Oh, yeah, and I thought CA was bad...  I am about to PCS to Germany and it is even more restrictive there as far as what guns you can bring.  I guess I'll just have to wait until I come back CONUS to a gun friendly state before I build my firearm colleciton :-(

Contact the Rod and Gun Club at your gaining area of Germany.  You can earn your German hunting license and eventually bring your guns from the US or purchase guns from the Rod and Gun Club.  I hunted in Germany for three years on private land and on the Grafenwoehr Training Area.  Caveat: It is VERY expensive.

CPL. You must be from MI.

I do my best to only get stationed in Free states so I can take my firearms with me. It is unfortunate that as free people would have to spend time reviewing laws of every locality where we may get assigned to avoid government prosecution for exercising a natural civil right.

You should contact the gaining Company Command Tm, thru your sponsor, and request specific information about your destined duty station. The guidance will vary between commands and should be structured from information the command will gain from the SJA (Army Lawyer Opine).  Often, they would either advise you to secure them with a trusted person outside of that particular state until your assignment is over. Other times, you will be instructed to turn them in to your gaining unit's arms room immediately upon arriving. Although, I have learned of some horror stories of Soldiers arriving at the gate of their new duty station, U-Haul attached, and being asked, "Do you have any firearms with you today?" and they answered truthfully only to find themselves being detained and searched by LE.

Typically, you would be able to transport your POWs on your orders and IAW state laws for transport regarding separate locked containers for the weapon and ammunition, and in an area not readily accessable like a trunk or a towed trailer. However, with the new state laws being the way they are, I would advise you to just secure them with a trusted friend or relative outside the state in question. Either way, call ahead and find out from your gaining chain of command.
