I certainly do not want to rain on your parade, but here is my own circumstance.
I received a field grade Article 15 for sleeping on 24 hour guard duty. I PCS'd 3 weeks later, and at my new duty station (within 45 days) I was diagnosed with multiple sleep disorders. I used that documentation to try to have my A15 overturned and get returned to my previous pay grade. No dice.
I was told by JAG, that to have that be a consideration, it would have had to have been diagnosed before the A15 proceedings.

And before I come across as a dirt bag for sleeping, even with the disorders...it was at a FASP and there was no sleep plan in the SOP, so in the absence of orders, I acted like an NCO and implemented a plan for the entire team. I was not planning to be asleep at any point, only planned on my guys getting a nap...and I fell out around 0330.

That's such a shame and Im so sorry that happened to you SGT Mitch McKinley. Every time I pull 24-hour duty, I let my runner go sleep a few hours upstairs (CQ in the barracks) and when he/she was done, I'd go sleep 3-4 hours. I was taught that's what a good NCO does.

My son was discharged because he showed up for work on time but had been partying the night before and smelled like alcohol. Can he get his GI Bill back? 5 years in and two tours to Iraq and Afghanistan. Help!

I received a general discharge after 12 years of service. I requested the discharge after several back surgeries. My brother went awoke after 2 1/2 years in and received the same discharge. Now he gets veteran benefits and I do not. The va said that since I served with the California and the iowa national guard that I was not considered a veteran. I was called to active duty then a couple weeks before 180 days released. Only to have it happen again. I have 2 active duty mos's 63h and 54b along with active duty bncoc.
