We have attempted to discharge Soldiers for APFT failure and have not been able to accomplish this to this point. soldiers have been counseled, remedial PT has been established. JAG keeps changing packet guidelines for counseling. Are there any real solutions for this.

No we haven't in the past, but with the down sizing coming, I would imagine you might see some cut for failing APFT.

We have had problems trying to put them out. Our JAG keeps change the counseling requirements.

When I was a First Sergeant for B Co, 1BSTB, 1ABCT, 4ID I separated 4 Soldiers for APFT failure. My chain of command, all the way to the BDE commander supported the CO and my decision. It was a tuff decision on a couple of the Soldiers, because they were good troops. They just could not pass their APFT, but there is only one standard and that is the Army Standard, which says Soldiers will not fail two consecutive APFT's or be recommended for separation.

I have seen a lot of Sailors put out of the Navy for it.  It doesn't seem to matter if that person is an excellent worker, leader, etc, or not.  I've seen people who can't pass their BCA that can run circles around, so called, in shape people, but that doesn't seem to matter either.
