Col Carl Whicker - for sure. However, that doesn’t change the fact that much of CPT D’s original post was far from ‘spot on’.

Let’s look at the inaccuracies. It isn’t ideological journalism. It is factually and legally incorrect for the president to assert that he is the Top Law enforcement officer.
The President appoints, with advice and consent from the senate, the Attorney General, who is the ‘CLEO’.

In regards to the cabinet positions, CPT D is also completely off base when he writes, “As with military staffs, the commander delegates functional authority but retains responsibility for all aspects of the Executive Branch”. That is Nonsense with a capital N.
The cabinet- level departments and their heads don’t derive their authority from Presidential delegation. Please understand that that authority is derived from particular legislation.

Is the President the Head of the executive branch? Of course. And he’s the boss. That’s not in question. Unfortunately, particularly for CPT Ds original opinion, I’d ask, if the President believes he is the CLEO (and by that rationale, top ‘everything’), why does the law so clearly state otherwise?

No, CPT was not spot on.

28 U.S. Code § 503 “ The President shall appoint, by and with the advice and consent of the Senate, an Attorney General of the United States. The Attorney General is the head of the Department of Justice“

"Journalists really should research their topic before going off on a rant..."--IMO there are no journalists anymore,only sensationalist with personal agendas.

By this rationale, I certainly hope the Surgeon General never runs afoul of the President. “I mean, I guess I’m the country’s top doctor, so you know..”

The President is the Commander in chief of the military, as directed by the Constitution. However, by law, the head of the Justice department is the Attorney General.

The President isn't the Top ‘everything’, simply because he’s the president.

I was thinking the exact same thing. If Trump says it, some people will just bend over backwards to argue that it's true.

When was the last time a Surgeon General examined a patient? Prescribed drugs? Operated? The Surgeon General is an administrative position. Yes, it makes sense for a doctor to occupy that cabinet post. And yes, he must perform critical administrative functions. But when the shit hits the fan, who is ultimately responsible? Regardless of the example set by some Presidents, I prefer Harry Truman's take on the subject.

When was the last time the Attorney General argued a case in court? The attorney general is largely an administrative position.

People would laugh if the President said he was the top doctor. Just as they would if they he said he was the top cop..
