Oh they can but their only option is to federalize the guard and send them back home then rip out the barriers that prevent the BP from doing their job as mandated. Which is exactly what I think they can do and if any member of the guard refuse MP's will arrest the individual and old for Court Martial. Then using heavy equipment they should rip out the barriers.
