This is the Tyranny we fear and rail against, the suspending of civil liberties and due process. When the Police Officer’s on the side of the road can effectively steal your money with zero due process, and then demand you prove it’s legally yours you have thrown out the legal premise “Innocent till proven guilty”. When you add in that it is in the Officers best interest to commit these acts of theft you have gone from Protect and Serve to Tyranny by Government Mandate. In 2015 a man in NC had his Business account wiped out by the Federal Government to the tune of $170,702.66. Because he made deposits under 10 thousand dollars. There was no criminal investigation, no crime had been committed, just suspicion and free money for the Government to take. Local cops also get a nice cut of the prize through the Department of Justice’s Equitable Sharing Program. So again it’s in their best interest to assume guilt with no proof. In the case above as with most the Government offered him a 50% of his money in return for not fighting them in court. He eventually won but it cost him over 20 Thousand Dollars to defend and recover his legal property. This practice has swept up dairy farmers in Maryland, an Army sergeant in Virginia saving for his children’s college education, An Old women that ran a Taco Stand in Iowa, A Family Candy store. On average the Government seized 34 thousand per seizure. Average cost to recover is 20 thousand.

This is free easy money for the State and Federal government to steal from the population. Make routine deposit’s under 10 thousand dollars and you are a target. Even after the “Suspended” this Practice the IRS is still using it now Oklahoma has decided on “acquiring” free easy money by shaking down of drivers. How many students with Prepaid cards are going to lose it all? How many low-income families with gift cards are going to have them stolen? Will the Police sit outside of the mall and just accost everyone post-Christmas?

This is a Violation of due process, sadly the people affected will never be able to take this to the Supreme Court so the practice can truly be ended.
