Man Who Repeatedly Shot Officer Accepts Plea Deal For 7 Years, Instead, Judge Blocks Sentence

Can't read this travesty of justice. Lip service to our men and women in blue as well as those families involved.

Capt Gregory Prickett - Sir I don't know where you were a cop, but I can tell you that the local patrol officers do not carry flashbangs or even have flashbangs. You don't just get to roll around with them in you car. They are an ATF controlled item. They are also a liability if not properly used because they are dangerous if not used properly. That is something for SWAT guys to use. So I assumed flashbangs equal SWAT. I would have thought you would know that Joe Patrol don't run around with a case of them in the car. So you are stating information that is not factual. One person said they didn't announce and the cops say they did. Since every cop in the fucking country knows that in order to effect a search warrant you have to read it out loud even if it is to a door for it to be legal (Unless you obtain a No Knock and you have to show cause). If the judge actually believed that the search warrant was not legally served he would have dismissed the whole thing. The cop was shot entering into a locked bedroom. You don't announce when beaching a bedroom. That is like saying, "I am coming in get ready to shoot me." So sleepy head was already awake and ready to shoot as soon as the door was opened. He was not disoriented he was able to wake up, get a gun, identify where the threat was coming, take aim and wait for the door to swing open. Again, a jury would have convicted on the attempted murder charge because the detective was in plain clothes. I could argue that case and win.

Capt Gregory Prickett - I misspoke. You have to knock and announce even to the door. Then guess what? You have to wait a "reasonable" amount for noncompliance before making forceful entry. So you read the warrant while standing there especially if you are making entry and have no knowledge of the case. That way while time passing there is no doubt to everyone there to the correct location and the scope of the search. Humm? You say, seems like a incredibly fucking responsible thing to do. I know right! Things get thrown out all the time because the scope of the warrant was not followed. How about breaking down the door of the wrong house? Checking that you are actually at the right house and the people making entry are aware of where and what they can search for.

I am not even sure where Shipley, KY is, but you would have been in the wrong town or at the right house with an invalid search warrant because the address is incorrect. Either way I am sure the pending lawsuit would explain why they are looking for a boat load of money. That is why you read them out loud before making entry. Everybody involved may be listed on a lawsuit if it is not handled properly.

As far as winning as case in court, just like being a cop, everybody know how to do your job. I saw an episode of Mattlock on TV so I am now an expert attorney.

Capt Gregory Prickett - How long are your warrants? I have never seen one longer than 2 pages. You don't have to read the affidavit, just the warrant. I can get through one in 20 seconds.
Since 90% of the country has a police force of 10 or less officers most places don't have a full time warrant service team or a full time SWAT. Most places will pull officers from adjacent jurisdictions or other local LE. They are not hanging around for 3 hours for a pre plan to the plan about the plan. You get them for 45 minutes and then they are gone from where them came. Our county has a joint SWAT team and unless it was a no knock it started at the driveway and ended at the door. The pre planning was done during training twice a month. When you get to the door you already knew who was doing what. It ain't rocket science.

Even a Liberal state wouldn't have citizens that condone this sentencing. Reprehensible on all levels. The judge signed off on the "shock probation" 7 year suspended sentence but it was lawyers on both sides that even put it in as part of the plea deal. What the hell is that about? And if this was all about a warrant search for drugs, why was majority of the drug charges dropped in the plea deal? There has to be more to this.

The Drug part was the roommate selling Meth out of the house. he wasn't selling the meth but he lived with the person that was.
So he wasn't looking at drug charges in the beginning other than as an accessories may be for distribution. The roommate had a warrant out for her arrest and was a dealer, from all that I have read.
As I have stated on another comment I don't like No Knock warrants but, I agree with the police on this one. he had to have known what his roommate was up to and that she was a criminal. You start shooting at cops and there are criminal elements going on you deserve to be put down. I have no sympathies for him.
