This was so misleading and causes hate and divide in our country ! Not to mention to put this State Trooper and his families lives in possible danger. I don't think many folks have heard this story.
Dallas attorney apologizes for client's rape allegations against state trooper after agency releases video. Dana branham, Dallas news
A Dallas attorney has apologized for his client's claims that she was sexually assaulted by a Texas Department of Safety officer who pulled her over, after the agency released body camera footage of the arrest late Tuesday.
The woman's allegations drew widespread attention after they were shared on Twitter by prominent columnist and activist Shaun King, who has since deleted the tweet. She had said the DPS trooper pulled her over in Ellis County early Sunday on suspicion of driving while intoxicated, repeatedly offered to let her go in exchange for sexual favors and sexually assaulted her when she declined, according to a statement from attorney Lee Merritt.
Nearly two hours of body camera footage shows the woman, 37-year-old Sherita Dixon-Cole of Grapevine, being pulled over, performing a field sobriety test and being handcuffed and booked into the Ellis County jail. She was released Sunday night after posting bond.
The footage "directly conflicts" with the account the woman gave to Merritt's office, he said in a written statement early Wednesday.
"It is deeply troubling when innocent parties are falsely accused and I am truly sorry for any trouble these claims may have caused Officer Hubbard and his family," Merritt said in the statement. "I take full responsibility for amplifying these claims to the point of national concern."
Merritt said he thanked the public for echoing the office's demands for justice, but "in this matter it seems your righteous vigilance was abused."
King, whose tweet about the allegations was widely shared before it was deleted, could not be reached for comment. His blog post detailing the woman's accusations was taken down Wednesday. He tweeted Wednesday afternoon that the body camera video "did not appear to show any verbal threats, sexual assault, or police brutality."
The DPS said in a written statement that after the arrest, "spurious and false" accusations came to light against the trooper. The department got authorization from the Ellis County district attorney to release the video from the officer's body camera.
Parts of the video are blurred or inaudible to redact the woman's personally identifying information, the department said.
"The Department is appalled that anyone would make such a despicable, slanderous and false accusation against a peace officer who willingly risks his life every day to protect and serve the public," the statement reads in part.
Ellis County District Attorney Patrick Wilson said Wednesday that his office had not made a decision to pursue criminal charges against Dixon-Cole, as it was still investigating.
"We’re trying to determine exactly what was said and who it was said to," Wilson said.
Wilson said he wasn't aware that the woman had filed a formal complaint with any agency regarding the sexual assault allegations.
