The only thing I'm gonna to say to this is stop comparing the race roits to the captiol riot. Both sides are attacking each other. Im no expert in law however I will say what happens inside cities falls within local ordinance and state laws first. Rioters could only be brought up on charges by the DOJ if they attacked federal property. Some attack federal property and those select few are were charged. Last summer a few tried to attempt a coupe against the Seattle government when Chaz was set up. If no federal laws were broken then the feds can do nothing. That would be up to the city and state. However those who stormed the senate building did so on federal land so the government can do what they wish with them. Even some haven't faced the maximum punishment and were still offered plead deals with the prosecutor's.
