No the President can federalize the National Guard. Think back to I believe when GOV of either Alabama or Mississippi refused Presidents integration order. President federalized Guard to enforce his executive order.

As a current member of the TXARNG serving on Operation Lone Star, I hope and pray our State and Federal leaders make good choices for the State of Texas and the nation. Unfortunately, that might be too much to ask…

Want the immigration issue solved? Tell the GOP congress to ignore Trump and pass a comprehensive bill. Of course that would take away his only issue to run on.

MSG (Join to see) - They have complied with the laws all along. Current laws state anyone applying for asylum must be given a court hearing. Others must be processed and have a court determination,
Don't like that? Get the GOP in Congress to get pass a new law.

So all those that are from a country other than Mexico should follow:
The so-called 'first country of asylum' principle often justifies the decision to return asylum seekers to another country. It means that a country can reject a person's asylum application if they have already been granted protection by another country. It is also often referred to as 'safe third country' principle.

MSG (Join to see) - That is covered in 8 U.S. Code § 1158 - Asylum.

But it still requires a hearing to determine such a status.
