When I was awarded 100% for Agent Orange Prostate cancer, I filed and was awarded CRSC. It stayed in effect when I was downgraded to 40%.
Here are the current requirements for CRSC.
You’re retired (and entitled to or receiving military retirement pay), and
You have a VA disability rating of at least 10%, and
You currently have your DoD retirement payments reduced by the amount of your VA disability payments

Thanks for the post! The expected change is related to drawing disability and retirement pay concurrently. As-is, the rule is 50% and higher will receive both va disability and retirement. Anything under is offset. https://www.dfas.mil/retiredmilitary/disability/crdp/

MSG (Join to see) - I'll support it 100%. I did not see any Congressional folks taking the lead here, did you. I can write to my Congressman and Senators, but since I am registered as a Democrat and they are Republican, I never get anything but a form letter back. I am moving down to AZ, so maybe there will be more help here.
We all need to follow up on this,

I look at this more as a penalty for retiring. No matter what, you get to keep your full disability. But retirees lose a portion of their retirement for being "not broken enough" which is BS. Folks who got out early and went to earn a civilian retirement (or invested and have independent retirement funding) are not similarly penalized.

The whole point of the disability pay is that it is harder to find a job that can fit your needs due to what the military broke. And you will also likely have to turn down / not apply for some higher paying jobs due to your limitations (I get debiliatitng stress-induced migraines. Find me a 6-figure job with low stress; I'll wait.). That job difficulty doesn't go away because you get a retainer check from the military (because we also have to remember that SCOTUS has ruled that retirement pay isn't ACTUALLY retirement pay, it is a retainer for potential future service).

The ONLY exceptions I could see to this is if you get a medical retirement disability payment from the military. Getting two disability payments *may* make sense to offset. But I admit I am not smart enough on the intricacies involved here to make a good judgment on that.
