Good on the judge. No religion or belief should be denied the ability to build a house of worship for their specific belief. NOW with that being said if that house of worship becomes a place of sanctuary for those wishing to do harm or harbor anyone that does (any religion) it needs to be shut down...just like the Geneva Convention...when a mosque or a church becomes a HQ for the enemy with guns on top or inside then it is no longer a Mosque/Church and can now be a target.
