Is it just an interpretation of the law that it was thrown out on, can it be argued at a latter time?

Cpl Benjamin Long My understanding is that the state can only appeal if they can show the judge's ruling was materially inconsistent with the law (i.e. he completely misread what the law says.). But @Capt Gregory Pickett can answer better.
