I'd be surprised if they weighed in saying that such mandates were illegal. The idea of vaccine mandates being legal for public schools and universities is pretty well established.

PO1 William "Chip" Nagel I was watching this case to see how it would play out. Using the 14th Amendment seemed far fetched to me, since students are required certain vaccinations to attend (and upheld by the Court in 1905).

The appeals court almost threw it out because the students filing were claiming religious exemption, which the university allows, but refused to wear masks or be tested on a regular basis.

I think that Justice Barret should have sent it to the full panel, but I do not imagine the outcome would have been different considering Justices Gorsuch and Kavenaugh's remarks about religious equitability.
