If it was a junior to mid NCO - senior NCOs get away with things too. Generally E9s. Maybe some E8s or E7s.

Hell - I know of a former SFC who got a plea deal in a case of sexual assault on a child and inappropriate communications with a junior soldier - no prison time. He got reduced one grade to E6, GOMOR and since he got reduce he was past RCP and separated. That crap happens quite frequently, unfortunately.

I'm not surprised at all. Not at all. I didn't realize he hadn't had his trial yet. I get his defense attorney is doing his job but: "Ray’s defense attorney, Jared E. Ausserer, confirmed the criminal case is set for trial in mid-September. Prosecutors are arguing that Ray should receive seven years prison time, which Ausserer said is excessive.

“[Prosecutors] have been unwilling to acknowledge that the PTSD components of Col. Ray’s service have any impact on this case whatsoever, and they’re treating him very differently than a civilian,” Ausserer said. “I have multiple clients who are charged with very similar conduct who are getting misdemeanors.”"

What the actual...yeah he should be treated differently than a civilian when he himself even listed off his "extensive training in combat" when threatening the police. Most civilians don't have his "extensive combat training."

And this:
"Ausserer stressed that Ray served several decades with no history of similar actions, adding that the military’s decision to honorably discharge his client reflects that. Army officials did not respond to requests for comment prior to this article’s deadline." --- Oh please. That means nothing.

I hope that his wife left him with their kids and is somewhere safe far, far away from him though.

Just because you have been charged doesn't mean your guilty. His retirement before judgement is perfectly legal.

Actually, no. During the legal process, individuals are flagged. Retirement isn't authorized while flagged. There was actually a Retired Master Sergeant (former CSM) recently who faked paperwork in order to retire and get around that prohibition. Since it was all over the news, clearly he got caught...

Having said that, if you read the story, he wasn't found "innocent", they're just not punishing him...
