I don't think any change in law would have altered this outcome.
Making murder more illegal?
I don't think those two were even remotely trying to be good citizens.
Maybe the evidence will say something different, but from what we've seen, this looks pretty cut and dried.

I will wait for the trial and the evidence. I don’t agree with what the perpetrators did. They were asked to watch the house under construction. The perpetrators saw Aubrey enter the house under construction and the perpetrators followed Aubrey. The perpetrators tried to stop and detain Aubrey . It appears Aubrey attacked one of the perpetrators and got shot. I am not sure this is as open and shut as people think. I do not agree with what the perpetrators did, it was stupid, but, if stupidity were a crime the streets would be empty.

Capt Gregory Prickett - I was wondering where the "Citizens Arrest" was coming from. I came across it in an article of the third person, who recorded the encounter, was arrested. That is where I found out that the suspects were trying to use that as a positive defense.

Capt Gregory Prickett - as I often say, we shall see. I do not believe private property is open to inspection by folks wandering around, including construction sites. We will see what happens in court.

Yes . But technically when a Security Guard Detains someone they are committing a "Citizens Arrest". Security Guards may have also used handcuffs. I have come across several in my years that believed their detainment was the same as my powers of arrest. I'm sure Greg can expound upon it but once a Security Guard detains someone they can not release them even if they realize they made a mistake. They have to turn them over to a Law Enforcement Officer who then can release or arrest the person detained, A Security Guard who detains and then releases is in for a world of legal hurt.

SSG (Join to see) - yes, you are correct. The whole process of Citizens Arrests is something that should be used with caution and understanding. It needs to be fully explained to new security guards. The average Citizen should avoid it at all cost, in my opinion.
