To my recollection, it has been the standard throughout Law Enforcement that a child below the age of 8 is incapable of committing a crime because they can not form the intent to commit a crime. This is a very absurd action to take for such a minor event.

I'm wondering if their is more to the story with this child's conduct at school. But if the parent or guardian is not going to discipline the child, then the state will have to.
