Depends on how strong of a case the prosecution can build. That's what people generally don't realize. The state has the burden to prove guilt in every criminal case. A defendant does not have to prove innocence. So if the state screws up their case and the defense can put a shred of reasonable doubt in jurors' heads - the person can walk.
