just because he was under UCMJ at the time doesn't matter they can still charge him under normal federal code title 18 which applies to everyone.

Under federal law, the punishment for rape can range from a fine to life imprisonment.

He's old, why bother paying someone for a year plus. More than likely they'll administratively reduce him in rank or some other trivial punishment. If the statute of limitations hadn't of passed likely this would be a much different story. Everyone hates to see a child rapist get off.
