Welll first, if you research it, Microsoft states he was not banned for this photo. Rather for a photo which was sexual in nature. Secondly, he is a grown man whose adult life most likely revolves around video games. Who literally cried to the world when someone shutoff online access to them for a few days. Having a hard time generating tears on this one.

Turns out the rationale is that it wasn't the picture that caused the banning.

PO1 Robert Payne - It was the night shift when I was reading it and did miss the other photo. Now knowing that I agree the guy is over reacting.
