Thomas Jefferson cautioned that judges have "the same passions for party, for power" and "their power is the more dangerous as they are in office for life, and not responsible, as the other functionaries are, to the elective control."
He stated firmly, "The Constitution has erected no such single tribunal, knowing that, to whatever hands confided, with the corruptions of time and party, its members would become despots. It has more wisely made all the departments co-equal and co-sovereign with themselves."

As long as the Congress and the executive branch allow theselves to be overruled by judges, this will continue. It's time for those 2 branches to put the judiciary in its place. Long past time, really.

I'd prefer that We the People be the judges of what is and what is not "constitutional". If our representatives in Congress pass bad laws, that We would replace them with better legislators. Sadly, that doesn't happen, and not even the Supreme Court has stemmed the tide of flotsam and jetsam that passes for law these days.
