System is not corrupt, people are. In any legal system, belief is not meaningful. Complying with the rules of the system is vital. There may be discretion in certain instances. Subjective decision shall be based on facts, precedence, and wisdom.

Thanks for your comment Sir! Well the issue here is fact finding and evidence. The lack thereof and political pressure that has resulted in many wrongful convictions of our service members.

The military has always been and will always be influenced by political ideas. Doesn't make it right, but anyone who thinks otherwise is kidding themselves. Anyone who thinks will change are mistaken.

That was probably one of the poorest examples of writing I have ever seen. The article references a few cases, but does not clarify what any of the cases are about. The poor writing detracts from what otherwise would be a poignant article that might do some good and inspire change. For the most part the UCMJ works well and the officers that are the convening authority do their absolute best to be fair and impartial; however at certain levels things become politicized and should probably be overseen by civilian courts who have the experience necessary to make proper rulings. I don't know if you know the O-6 who wrote this article OP, but that shot was literally painful to read.

MSgt Lisa Silva - I have seen that happen, but it is still far better than the civil alternative, False accusation mean little other than someone was lying or simply wrong, I do not think that the Military false conviction rate is nearly as high as the civilian rate,, not to mention the appeals process is more robust.
One thing that obviously does need fix is that Admiral Lorge is not facing a court since he openly is confessing to a serous crime, he succumbed to the pressure from abouve for Personal gain, so the most he deserves is a royal "F*** you"

And MSgt I'm pretty much agreeing with you to a point. I think lower level stuff UCMJ is great and works. At high levels should be sent to civilian magistrate.

MSgt Lisa Silva - the same thing I would say to the thousands under the civilian system the system is not perfect but the UCMJ does have a lot of things the help the accused. We tend to get the accused the better lawyers in the military.

Thanks for your reply! That's what people don't understand is the false conviction rate is VERY HIGH in the military. The appeal process a rubber stamp for the most part from your own branch and you are lucky if it is reviewed by CAAF, most are denied. There are a few getting overturned on appeal but not many, 3-4% was the average. Many cases the military member has proof they weren't even in country when the allegations occurred. What the jury doesn't get to hear would surprise you. There has been over a 600% increase in sexual assault convictions since 2011. Now some would say that's justice working, but if you saw the cases the investigation packages, the records of trial, you would see the truth. Bottom line we need justice not politics, investigate and support both sides, because in many instances it's the accused that is the real victim.
