This judge is not upholding the law. President Trump has the responsibility and the duty to protect Americans. If that means doing the same damn thing that Obama did to keep terrorists from killing Americans then I'm all for it. Even if it hurts some hypocritical liberal a**holes' feelings in the process.

Trump has the responsibility to uphold the constitution. That's the oath he took.

"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."

I am an construction manager and as such I have difficulty understanding people who engage a course of action without thinking thru the possible ramifications. This EO was not looked at for legality or even for its delivery.
Do I think the intent has merit? Yes I do, but the path to the objective was underdeveloped and researched.
Capt Pickett and SPC Voye, kudos on your intelligent dialog and discussion. It's refreshing to see people with differing opinions discuss them with respect.

Trump's wrong. How many judges have looked at the EO so far? And how many have backed it? Compared to how many stayed it?

Did anyone notice how quickly both State and DHS backed off of the EO after Judge Robart's order?

Austin Hocutt - Ali Vayeghan was deported (on a visa), and a federal judge ordered that Customs (CBP) bring him back.

Just before one of my shifts providing legal representation at DFW, CBP held a child who was a U.S. citizen and refused to release him to his father (also a citizen) - it was my understanding that they only released him when they found out we were about to file for a writ of habeas corpus in federal court.

In Virginia, evidence was presented that two Yemeni LPRs were coerced into signing a -407 and were deported to Ethiopia.

In Chicago, lawyers prevented CBP from deporting an 18-month old US citizen with her LPR mother.

I can go on and on.

It's illegal.

I can not find anything about the 2nd Paragraph.

The two Yemeni's did not have green cards, they had Family base Immigrant visa's. IR-2's.

I also can find anything about the incident in Chicago.

Austin Hocutt - LOL, really? You do realize that an IR-2 visa is a conditional legal permanent resident status, don't you? The court order outlines this, and the fact that they were coerced into signing the I-407, which is a "Record of Abandonment of Legal Permanent Resident Status." Surely you don't intend to claim that you know the law better than I do? Really?

I'm not going to argue points of law with someone who doesn't have a clue about what's involved. First you claimed that since they weren't U.S. citizens that they don't have legal rights. Please do not confuse your Google search with my law degree - it's nowhere near the same.

I never would claim I know more than you when it comes to law. Because I'm actually googling shit. So that means I'm obviously lacking in this knowledge, though I am trying to do a bit of discerning between what the Media tells us, and what actually happened, as every media outlet adds their own twist to the story, and what I do is I find where everyone makes their twist, and I think of what could be the middle ground.

I've been merely bouncing what I've found after a simple google search and about 3 pages worth of research into what we're talking about and see what you have to say about it.

That's incorrect.

A President is not allowed to replace a Title III judge, they can only be removed by death, impeachment, or resignation.

BTW, Judge Robart was appointed by Bush II and was confirmed 99-0 as a conservative Republican.

SFC George Smith clinton didn't dismiss sitting judges. He dismissed politically appointed attorney generals, just as Reagan did and Bush did. He did do it all at once rather than spread it out more, the same way Trump told all the Ambassadors to resign on inauguration day rather than wait for a replacement to be confirmed.

close
