I would be okay with an ART 15, but she may be refusing NJP. She also has given interviews defending her actions so her CoC may consider that an escalation deserving of more. She just doesn't seem to get that what she does in uniform is different from what she does as a private citizen.

Nonjudicial punishment, Article 15, may have been appropriate if it was a local violation and came before the company commander. After sailor put the video on the internet and came to the attention at a higher level, it is proper to prosecute under Article 92. I think it would be more appropriate to prosecute under Article 134, Disloyal statement. Maximum punishment under 134 is three years confinement. I have no idea what the actual punishment for this particular offense should be.

MSgt Danny Hope There is difference between defending the Constitution and using it.We (military) all defend it,but by contract relinquish certain aspects of it.
Punishment is definitely justified in this case.
