Seems like the driver of the van will be the only one to get a punishment. It was their responsibility to restrain him. Not sure which one of the officers it was.

Yes most likely the Driver will be the one with no chair when the music stops. In LE one can actually break a law if they are within dept policy. However, once one violates dept policy then they are wide open. A policy violation is the path to termination and mitigation of the agency's liability. An example would be the use of car computers: my agency has a policy against typing and driving. But it is also understood that the job cannot be done without doing so. So having a collision while operating the patrol car can be problematic if one says they were using the computer at the time. So, the Driver had stated that he received little to no training on securing prisoners. He also said safety gear in the van was missing or Inop. Training records will show that he was likely given a minimum train up on securing prisoners. Also, there will be a policy concerning Safety inspections of equipment. Two potential policy violations that could have some causation in the injury and death of Mr Gray. I believe the BPD stated that regardless of the trial outcome, all the officer face a Dept review of policy violations for grounds to terminate.

It turned out that just after this RP discussion a CHP officer rear ended a stopped vehicle. A teen was killed. The indicators are that the officer was/may have been using the car computer. CHP will have a policy in that.
