What First Amendment rights would apply in this situation? I don't see where there is government action being taken to restrict Ms. McDaniel's First Amendment rights.

Patricia Overmeyer The comment is meant to be analogous to the suits filed on the violation of the 1st amendment. As an attorney you already know that a private citizen cannot sue another individual or a private company for violating their First Amendment rights.
It is interesting that on average, the U.S. Supreme Court considers about 7,000 to 8,000 petitions each term, and accepts about 80 for oral argument. This means that a significant number of cases related to the violation of 1st amendment rights are filed each year, but only a small fraction of them are selected for oral argument at the Supreme Court.
The majority of First Amendment lawsuits and court cases are brought against government entities, not private parties. The American Civil Liberties Union (ACLU) tracks many of the key First Amendment cases that reach the U.S. Supreme Court.

SPC Jeff Daley, PhD - Ah ok, thanks for the clarification. (Should have put a snark tag there.) If I hear one more "my 1st Amendment rights" argument that doesn't involve government action I just have to go scream into the void. And I've seen quite a few on this site. SMDH.

Rachel Maddow can shrivel up and drift away as far as I am concerned...somewhere there is a tree screaming cause it had to make oxygen for her to breathe!!!

She fits right in at PMSNBC, since their on-air "talent" all seem to get more money for not succeeding.
